By using this Platform, you represent and warrant that:

• You are at least 18 years of age
• You are legally capable of entering into binding contracts under applicable Indian law
• You are accessing the Platform for lawful purposes only
• The information you provide during registration or checkout is true, accurate, and current

If you are accessing the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3.1 Registration

Certain features of our Platform, such as placing orders and tracking deliveries, may require you to create an account. You agree to provide accurate and complete information during registration and to keep your account details updated at all times.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password and OTP. Any activity that occurs under your account is your responsibility. Please notify us immediately at support@kmsativa.com if you suspect any unauthorised access to your account.

3.3 Account Termination

KM Sativa Foods reserves the right to suspend or permanently terminate your account at its sole discretion, without prior notice, if you are found to violate these Terms, engage in fraudulent activity, or misuse the Platform in any manner.

We take every effort to present our freshly milled flour products as accurately as possible on the Platform. However:

• Product images are for illustrative purposes only and may vary slightly from the actual product
• Product availability is subject to change without prior notice
• We reserve the right to limit quantities or discontinue any product at any time
• Pricing is displayed in Indian Rupees (INR) inclusive of applicable GST unless stated otherwise

Since our products are freshly milled and may have natural variations in texture, colour, and aroma depending on the grain and season, such variations shall not be treated as defects.

5.1 Placing an Order

By placing an order on our Platform, you are making an offer to purchase the selected products at the listed price. KM Sativa Foods reserves the right to accept or decline any order at its discretion. An order confirmation sent via email or SMS does not constitute acceptance until the order is dispatched.

5.2 Pricing

All prices are subject to change without notice. In the event of a pricing error, we reserve the right to cancel any affected orders and offer you the corrected price or a full refund.

5.3 Payment

All transactions must be completed at checkout using our secure payment mode. Accepted payment methods include UPI, credit/debit cards, net banking, and other methods as displayed on the Platform. We do not store any payment card information. All financial data is handled by our PCI-DSS compliant payment partner.

5.4 Order Cancellation

Orders may be cancelled only before dispatch. Once dispatched, orders cannot be cancelled. Please refer to our Purchase Policy for detailed cancellation procedures.

KM Sativa Foods delivers across India. By placing an order, you acknowledge and agree to the following:

• Delivery timelines are estimates and are not guaranteed
• KM Sativa Foods is not liable for delays caused by logistics partners, natural events, strikes, or other factors beyond our control
• Risk of loss or damage passes to you upon delivery of the product to your specified address
• It is your responsibility to ensure someone is available to receive the delivery; failed delivery attempts may result in the return of the order

Our Return and Refund Policy governs all requests for returns, replacements, and refunds. Products are non-returnable once delivered, except in cases of damage, defect, or incorrect delivery. All content on the Platform — including but not limited to the KM Sativa Foods brand name, logo, product photographs, website design, text, graphics, and compiled content — is the exclusive intellectual property of KM Sativa Foods and is protected under Indian intellectual property laws.

You may not reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit any content from this Platform without prior written permission from KM Sativa Foods.

You agree not to use the Platform for any of the following:

• Engaging in fraudulent transactions or impersonating any person or entity
• Submitting false, misleading, or defamatory reviews or content
• Attempting to gain unauthorised access to any part of the Platform or its systems
• Using automated tools, bots, or scrapers to access or extract data from the Platform
• Interfering with or disrupting the integrity or performance of the Platform
• Violating any applicable local, state, or national laws or regulations

Any violation of the above may result in immediate account termination and legal action as deemed appropriate.

The Platform and all its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. KM Sativa Foods does not warrant that:

• The Platform will be uninterrupted, error-free, or free from viruses or harmful components
• The information on the Platform is always accurate, complete, or up to date
• The products will meet every individual's specific dietary requirements or health expectations

While our products are freshly prepared using traditional methods, KM Sativa Foods makes no medical or nutritional claims unless explicitly stated on the product packaging.

To the maximum extent permitted by applicable Indian law, KM Sativa Foods, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Platform
• Any errors or inaccuracies in the content on the Platform
• Unauthorised access to or use of your account
• Delays in delivery or damage caused by third-party logistics partners
• Any other matter relating to the Platform or your purchase

Our total liability in any matter arising out of or related to your use of the Platform or purchase of our products shall not exceed the value of the order in question.

You agree to indemnify, defend, and hold harmless KM Sativa Foods and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your breach of these Terms, your use of the Platform, or your violation of any law or the rights of any third party.

Our Platform may contain links to third-party websites for your convenience. KM Sativa Foods does not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party website. Accessing external links is at your own risk, and we encourage you to review the terms and policies of those websites independently.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872, the Consumer Protection Act, 2019, and the Information Technology Act, 2000.

14.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising from these Terms or your use of the Platform, we encourage you to first contact us at support@kmsativa.com to seek an amicable resolution. If the matter cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts located in Madurai, Tamil Nadu, India.

KM Sativa Foods reserves the right to revise, update, or modify these Terms at any time without prior notice. Changes will be effective immediately upon being posted on the Platform. It is your responsibility to review these Terms periodically. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These Terms, together with our Privacy Policy, Purchase Policy, and Return & Refund Policy, constitute the entire agreement between you and KM Sativa Foods with respect to your use of the Platform and supersede all prior communications, representations, or agreements.
